When do fathers stop paying csa
When child maintenance is paid it can make a significant difference to the lives of families. This guide sets out the various types of child maintenance arrangements available to parents.
Parent — Usually the parent will be the biological parent of the child, but you do not have to be biologically related to the child to be considered a parent.
For more information see Children and the law: parental responsibility. Resident parents are sometimes referred to as the parent with care. Child Maintenance Service CMS — This is a service run by the Government to arrange and collect child maintenance from the non-resident parent and pay it to the receiving parent if this is necessary.
Child Support Agency CSA — This is also a service run by the Government to arrange and collect child maintenance but only deals with old applications set up before December All new applications are dealt with by the Child Maintenance Service. Private agreements for child maintenance.
You can agree child maintenance with the other parent by negotiating with them directly or through your solicitor. You can record this in a private agreement form available from Child Maintenance Options see Useful contacts.
The benefits of an agreement are that neither party will have to pay Child Maintenance Service fees and the parents can change the maintenance rates by agreement as their circumstances change. Arrangements for child maintenance made by way of agreement are not legally enforceable. This means that if the non-resident parent decides to reduce or stop their maintenance payments you cannot force them to stick to the agreement. If the non-resident parent stops paying or reduces maintenance you should contact the Child Maintenance Service.
The non-resident parent will only be required to make payments from the date you apply to the Child Maintenance Service. He is a specialist in child maintenance and has previously appeared before the House of Commons Public Accounts Committee to talk about the practicality of the rules surrounding the Child Maintenance Service.

What triggers payment of child maintenance? If an application is made to the court, rather than the CMS, then the court is free to decide the start date for the maintenance payments: a Generally the start date is when the court makes its order; b though the court can elect to back date the payments to any time as far back as the date of the application; c finally there are special rules if the court is making an order following the end of a CMS award … here it can back date even longer, up to six months.
Geography : The parent with care and the child must be based in the United Kingdom — as must with some exceptions the non-resident parent; Age and stage : Broadly, the CMS has jurisdiction until the 31 st of August in the year that the child completes their A-levels; Parentage : Applications can only be made by a person who is in law the mother or father of the child.
An application can be made at any time for the CMS to cease acting but, subject to certain exceptions, there is nothing to stop a new application then being submitted. This may be agreed privately between the parents, but more often is calculated by the Child Maintenance Service formerly CSA.
If you apply for any benefits, you may find that a claim is automatically made with CMS to obtain payment from the other parent. The non-resident parent will have to pay an agreed percentage of their monthly income to the resident parent who is responsible for the everyday care of the child.
Joint Residency If there is Joint Residency or the non-resident parent looks after the child for a number of days each week, then this will reduce the payments. If the child stays over night with the non resident parent on average at least one night a week, this is classed as shared care. In this case maintenance can be reduced as long as the basic rate or reduced rate is being used. Previous Page. Next Page. You might also like After the Initial Court Order.
